David L. Puskar

Biography

Attorney David Puskar’s practice focuses on civil litigation and the representation of creditors in bankruptcy proceedings.  Dave regularly assists corporate, municipal and individual clients in state and federal courts throughout the State of Michigan, on matters which include business tort claims, commercial transactions, municipal law, ordinance and development disputes, and real estate litigation. Dave has handled numerous matters through trial (both jury and bench), as well as alternative dispute resolution proceedings such as facilitation and case evaluation. Dave is also experienced in commercial arbitration, including arbitrating matters with the American Arbitration Association.

In addition to his civil practice, Dave helps creditors in, primarily, Chapter 7, Chapter 11, Chapter 12 and Chapter 13 bankruptcy proceedings before the United States Bankruptcy Court.  Dave handles a wide variety of contested matters and adversary proceedings, including the litigation of dischargeablity issues.  He routinely counsels creditors on strategies to maximize their recovery through the bankruptcy process. This often involves the filing of motions for relief from the automatic stay, objections to plan confirmation and proofs of claim.

Dave has also developed a focus on representing individual physicians and medical practices, including in relation to the federal Anti-Kickback statute, Stark Law and False Claims Act.  His work in this space has involved responding to Department of Justice investigations, negotiating with the federal government, and evaluating physician contracts and relationships.

While in law school, Dave completed externships with Ohio’s Sixth District Court of Appeals and the Toledo Bar Association’s Pro Bono Program. Dave was also a two year competition member of the University of Toledo’s Trial Advocacy Team, earning the Most Outstanding Advocate award each year. Through his participation in UT’s Trial Advocacy Program, Dave was selected to be a National Member of the Order of Barristers.

Dave is a Past Member of Braun Kendrick’s Executive Committee, having served two terms from 2017 to 2022.
